Judge Bars Key Witness From Civilian Terrorism Trial - NYTimes.com

Undoubtedly, conservatives - a group to whom I belong - will decry this decision by Judge Kaplan as liberal activism, and assert that the judge is ruling in favor of the suspect's rights over the rights of the victim.

In this case the judge is correct. A true conservative holds the Constitution above all else in law, and the 5th and 14th amendments are crystal clear in this case.

What I hope conservatives say is: THIS IS WHY THESE PROCEEDINGS DO NOT BELONG IN CRIMINAL COURT!

Judge Bars Key Witness From Civilian Terrorism Trial - NYTimes.com: "“The court has not reached this conclusion lightly,” Judge Kaplan said as he read his order from the bench. “It is acutely aware of the perilous nature of the world in which we live. But the Constitution is the rock upon which our nation rests. We must follow it not only when it is convenient, but when fear and danger beckon in a different direction. To do less would diminish us and undermine the foundation upon which we stand.”"
